Rental Agreement & Cancellation Policy

RENTAL AGREEMENT, RULES, AND REGULATIONS

1.CHECK-IN TIME IS AFTER 4 P.M. EST AND CHECK-OUT IS 10 A.M. EST. No Early Check-in or Late Check-out without prior approval from the owner. FINE: Without prior approval, Renter will be fined $100 per hour.

2.MAXIMUM OCCUPANCY- Per Sevier County, the maximum number of occupants is limited to (12) persons. Renter must correctly disclose the number of adults, children, infants and pets when booking their reservation and notify owners of undisclosed guests or pets in advance of arrival. FINE: Any additional, last minute or undisclosed guests or pets will be charged a nightly rate of $100 per person/pet.

3. SEVIER COUNTY ZONING RESOLUTIONS – By accepting this rental agreement you agree to abide by Sevier County Zoning Resolutions

FINE: If we receive notice from a neighbor or local authorities of any violations, your reservation will be terminated, and you will be required to leave the premises immediately and forfeit all payments.

4.PARKING – The property has 4 parking spots for a 4-vehicle limit. If your vehicle gets stuck, it will be at your expense to get it moved.  The parking of boats, trailers or RVs on the property is not permitted. Parking restrictions are strictly enforced. FINE: Your vehicle will be towed to an impound lot at your expense if the parking rules are violated.

5.MINIMUM AGE REQUIREMENT - We do not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. FINE: Immediate termination of reservation and forfeiture of all payments.

6.FALSIFIED RESERVATIONS, SUBLEASING - Any reservation obtained under false pretense will be subject to forfeiture of advance payment or rental money, and the party will not be permitted to check-in. Subleasing is not allowed. FINE: Immediate termination of reservation and forfeiture of all payments.

7.EVENTS – No events or parties of any kind permitted on the property. FINE: Immediate termination of reservation and forfeiture of all payments.

8.SECURITY - Seven (7) security cameras are visibly located outside. No type of security cameras or recording devices are located inside the chalet. FINE: Tampering with the security cameras, WIFI or signal extenders will result in immediate termination of reservation and forfeiture of all payments.

9.WIRELESS INTERNET – Internet download/upload speed is 150 Mbps/20 Mbps. The login information is in the Guest Book located in the house. When using our wireless internet, you agree to abide by all federal and state internet laws including but not limited to trafficking and child exploitation.

10.SMOKE DETECTOR AND CO2 DETECTORS – Smoke detectors and CO2 detectors are installed throughout the house per code. Do not tamper with either. FINE: Tampering with a smoke detector or CO2 detector will result in immediate termination of reservation and forfeiture of all payments.

12.NON-SMOKING RESIDENCE - Smoke and vape outside, away from open doors, open windows, and not on the screened porch. Properly dispose of your butts. FINE: $500 per violation.

13.PROPERTY DAMAGE PROTECTION POLICY / SECURITY DEPOSIT – A Property damage protection policy and security deposit will be required for the dates listed on the reservation. Renters are responsible to ensure:
‎a. No damage is done to the residence, or its contents beyond normal wear and tear.
‎b. No charges are incurred due to contraband, pets, damage, or violation of this Rental Agreement during the stay.
‎c. All debris, rubbish and discards are placed in the bear proof garbage bin and not left outside or in the screened porch at any time.
‎d. Soiled cookware, cutlery, drinkware, flatware, serve ware and dishes are cleaned by hand or placed in the dishwasher and cleaned.
‎e. All residence doors and windows are locked and bolted (if applicable).
 Keys are returned to the lock box, if applicable. FINE: $250 if key is not properly returned to the lock box.
‎f. No linens, towels, cookware, cutlery, drinkware, flatware, serve ware or dishes are lost or damaged.
‎g. The renter is not evicted by the owner (or representative of the owner), or the local law enforcement.
‎h. Renter and their guests read, understand, and follow the guidelines listed in this agreement and the Guest Book
‎i. Damage is reported to the owners no more than 24 hours after checkout.

Renters are completely responsible for any and all damage to the residents, contents or property caused by Renters, whether accidental or due to Renter’s or Guest’s negligence.  Renters understand the rental policy provides up to $3,000 in accidental damage protection. Renters agree to notify the owner of damage and assist the owner in making a claim.  Renters understand that Renters are responsible for damage beyond the coverage provided by the accidental damage insurance.  Renters are also responsible for damage that would have been covered by the accidental damage insurance if Renters fail to advise the Owner of the damage and provide the necessary information that would allow the Owner to file a claim against the policy. Any items removed from the residence is considered theft. Local authorities will be notified, and the Renter will be prosecuted through Tennessee Law. If a security deposit is accepted, it will be used towards damage, repairs, replacement and legal fees, if needed. The remainder will be returned within 10 days of checkout. 

The Owners, contracted employees and relatives are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The owners are not responsible for the loss or damage of personal belongings or valuables of the Renter. By accepting the reservation, it is agreed that all occupants are expressly assuming the risk of any harm or expenses arising from their use of the premises or others whom they invite to use the premise.

14.PAYMENT - 50% of the rental rate is due at booking. Payment in Full is required 30 days before arrival. 

15. CANCELLATIONS One hundred percent (100.00%) of the total booking charges (minus the credit card fee) will be refunded if the cancellation is made more than 60 days prior to the arrival date of the reservation. Fifty percent (50.00%) of the total booking charges (minus the credit card fee) will be refunded if the cancellation is made more than 30 days prior to the arrival date of the reservation. For cancellations made within 30 days prior to the arrival date, no refund will be issued.

16.STORM POLICY - No refunds will be given unless the National Weather Service orders mandatory evacuation for the local area. The day that the National Weather Service orders a mandatory evacuation order in a "Storm Warning," area, we will refund:
‎1. Any unused portion of rent from a guest currently registered,

‎2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Storm Warning is lifted; and resume their reservation.
‎3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Storm Warning" period.

17.TRIP INSURANCE – We encourage guests to purchase trip insurance since we do not provide refunds or reschedule booked dates for guests that are no longer able to receive a refund for their reservation. Subleasing is not allowed.

18.AMENITIES AND COMPLIMENTARY ACCESSORIES - You agree to take responsibility for you, your relatives, friends, and guests to ensure accessories, including but not limited to the charcoal grill, indoor gas logs, outdoor fire pit and popcorn machine, safety ladder are used correctly and safely.  You agree that even the proper use of these items can be dangerous, and therefore assume the risk of injury, and hold the owners harmless from any loss or injury occasioned as a direct result of their usage.  Owners are not responsible for utilities and amenities that become unavailable due to circumstances beyond our control.

19.INCLUSIVE FEES - Rates include a one-time linen-towel setup.

20.NO DAILY MAID SERVICE - Linens and bath towels are included in the unit, daily maid service is not included in the rental rate. Bath towels and bed linens cannot be taken from the residence or used on your dogs. Separate towels for pet use are in the laundry room.

21.EXCESSIVE CLEANING AND BIO CLEANING FEE FINE: Excessive cleaning fee of $150 per hour will be charged for any cleaning that is required above and beyond the normal usage of the cottage during the guests stay. This fee is in addition to the prepaid cleaning fee. Excessive cleaning of the hot tub incurs a $200 fine.

22.HVAC SYSTEM – Each HVAC system is linked to the door and window sensors. The thermostats will detect if a window and/or door is open and turn the HVAC system off until the door or window is closed.  Gas logs will heat the inside of the house quickly. Do not overwork the AC system by running the gas logs while cooling the house. The thermostat will detect if it is unable to heat/cool properly and will turn off to prevent damage to the HVAC system.

23.FAMILY ROOM  ELECTRIC LOGS – Do not open the chimney flue. The electric log remote is located on the fireplace mantel. Turn ON the electric logs by pressing the power button on the remote.  Turn OFF the logs by pressing the power button. Do not place anything in the fireplace. Do not touch or move the fireplace screens or logs. Note: There is a minimum fee of $300 charged for each lost or broken fireplace remote by the fireplace service provider.

24.BUNK BED WEIGHT LIMIT - The advertised weight limit of each surface is 400 lbs. Jumping on beds may result in damage and is prohibited. 

25. HOT TUB -  Hot tub rules are posted in the Guest book and on the wall near the Hot Tub. By using the Hot Tub, you agree to follow those rules. Fines incur if rules are violated.

26.SEPTIC SYSTEM – The house has a septic system. Do not let bleach or other harsh chemicals like bleach go into the septic system. DO NOT Flush “Flushable Wipes” or makeup remover wipes down the toilets.

27.PETS - A maximum of 2 dogs are permitted in the residence if disclosed in your reservation and pay the $200 pet fee. Other pets are not permitted. During your stay, owners are required to clean up after your pets. Do not wash them inside. Separate towels for pets are in the laundry room. Do not let dogs roam freely on or off the property. FINE for unapproved pet is $100/pet for each night of the violation. Fine for other pet rule violations: $50/occurrence.

28.BEARS, GARBAGE & TRASH COLLECTION - Do not leave garbage or food (including dog food) outside, on the screened porch, on the balconies or decks, in the trunk of your car or in the bed of your truck. Dispose of trash in the bear proof trash can provided. Place all trash in a trash bag before placing it in the bear proof trash can. Latch the door to the trash bin. FINE 

29.FIREWORKS & FIREARMS – No fireworks, sparklers or pyrotechnics allowed on the property. Firearms (shotgun, rifle, handgun) cannot be discharged on the property. FINE: Immediate termination of reservation, forfeiture of all payments and $500 fine.

30.PLANTS & FOLIAGE - Do not cut, break, or intentionally damage trees or shrubs on the property. This includes the foliage. Do not zip tie, nail, or attach anything to the trees or shrubs without the owner’s pre-approval or knowledge. Do not spread rock salt near trees or shrubs. FINE: Renter will be fined a sufficient amount to replace/repair the damage.

31.OUTSIDE MAINTENANCE – We have contract employees to perform outside maintenance. It is not on a regular schedule since different services are required in different seasons. You may see them walking on the property.

32.TURKEY FRYERS AND BARBEQUE SMOKERS - No turkey fryers or barbeque smokers allowed on the property. FINE: Immediate termination of reservation and forfeiture all payments.

33.OUTDOOR URINATION – Do not urinate outside or any other place other than the bathroom toilets. FINE: $100 per occurrence

34.OUTDOOR FIRE PIT & FURNITURE - Do not cook anything other than marshmallows or hot dogs in the firepit or burn anything other than firewood. Do not stand, walk, or jump on top of the firepit. Do not leave your fire unattended. Do not store wood up against the house. Do not set hot items, like the fire poker, on the plastic Adirondack chairs or bench because they will be damaged. Do not move the furniture away from the firepit patio area. Do not set the furniture on the rock wall. Minor children must be supervised around an active fire in the fire pit

35.OUTDOOR CHARCOAL GRILLE - Do not burn anything other than charcoal in the grill Clean the grill after each use. Fine of $75 if not cleaned.

36.RENTAL AGREEMENT VIOLATIONS AND FINES: Unless the fine is listed, violations of the rental agreement could incur immediate termination  without reimbursement of reservation without refund and/or fines no less than $50 per occurrence.

37. SPLIT RAIL FENCE - Do not sit, stand, jump or play on the split rail fence. It is purely decorative and will break.

38. STRING LIGHTS - All string lights are either on a timer or use a dusk to dawn sensor. Do change the settings or remove the bulbs or move the string lights.

39. PLAYSET & MINI GOLF - Children must be supervised at all times when playing outside by an adult. You agree to use these amenities only as intended.

40. OUTDOOR FURNITURE - Do move or relocate any furniture outside. Extra cleaning fees will incur if furniture needs to be replaced. Do not move any furniture from inside, outside. This includes the balconies and porches. The furniture should not be climbed or played on and used only as intended. This includes the egg chairs on the deck. You agree to use the amenities only as intended by the owner and manufacturer.

41.PAYMENT OF FINES Renter will be notified of Rental Agreement violations and associated fines. Renter agrees to pay incurred fines to property owner. Tennessee law controls all disputes regarding the agreement.

42. CHARGEBACK WAIVER – By booking this property, the guest agrees to waive their right to initiate a chargeback for any transaction related to this booking.

43.WRITTEN EXCEPTIONS - Any exceptions to the above-mentioned policies must be approved by the Owner in writing in advance of Renters arrival.
